CONDUCT OF THE AUCTION:

Conduct of the auction and increments of bidding are at the direction and discretion of the auctioneer. The seller and selling agents reserve the right to preclude any person from bidding if there is any question as to the person's credentials, fitness to bid, financial ability to buy, etc. All decisions of the Auctioneer are final.

TERMS:

10% down or $1,000.00 which ever is greater the day of Auction, balance due in full upon delivery of the merchantable title and deed free and clear of all liens and encumbrances except as stated herein and subject to easements or restrictions of record. A 5% buyer's premium with a minimum of $1,950.00 will be added to final bid and included in the total contract price. This is an absolute auction with starting minimum bids.

CONDITIONS:

No offer can be accepted that is contingent on financing. You must have proof of available funds, or a letter of guaranteed credit from a lending institution. The Receiver will contact the lender before accepting the successful bid. There must also be proof that there are immediately available funds to cover the 10% downpayment. The 10% down payment will be totally forfeited in the event the successful bidder refuses to proceed to closing.

TAXES:

The Buyer shall be responsible for the November 2010 taxes and all taxes thereafter.

POSSESSION:

1 day after closing subject to tenants rights.

EXECUTION OF PURCHASE AGREEMENT:

The successful bidder will be required to execute a written Agreement to Purchase Improved Real Estate Contract immediately following the close of the auction. Buyer's offer expires at 11:59 P.M. (local time) April 6, 2010.

SURVEY:

No survey will be provided by the Seller; a legal description is available in the pre-Auction materials. If a survey is requested, it will be paid for by the Buyer.

AGENCY DISCLOSURE & GENERAL OFFICE POLICIES:

Ness Bros. Auction Staff (Auctioneers and Ringmen) will represent the Seller exclusively unless Ness Bros. Agent has a signed buyer agency agreement with buyer, then that agent has a limited agency with buyer.

CLOSING:

Balance of purchase price is due in cash at closing, which will take place within 20 days after acceptance of the offer. Lime City Title Company to provide the Commitment for Title Insurance and the buyer will be responsible for the cost of the commitment.. The fee charged by any closing agent for closing services shall be paid equally by the parties. Buyer will be responsible for paying a $195.00 transaction fee to be collected at closing.

NOTE:

Neither Seller nor Ness Bros is responsible for any personal property left in the residence and buildings, or on the land at the time of closing.
